What is the Central Credit Register


The Central Credit Register is an information system managed by the Central Bank of the Republic of San Marino (CBSM), which consolidates information on customer indebtedness provided by participating intermediaries, including banks, financial companies, mutual funds primarily composed of loans, special purpose vehicles, CBSM, and guarantee funds.

The system collects and shares with participating intermediaries both master and quantitative data on loans granted, with a census threshold of 10,000 euros or more (the threshold for non-performing loans, net of loss pass-throughs, is 250 euros or more). It also includes information on the insolvency status of debtors, regardless of the loan amount (i.e., non-performing loans), guarantees received, and additional detailed loan-related information.

Who can request access to data

For data of natural persons:

  • The natural persons in whose name the information is recorded, or their guardian, curator, or heir (including the person called to the estate).

For data of non-physical persons:

  • the legal representative;

  • the trustee in bankruptcy or other body of insolvency proceedings responsible for representing the company;

  • the person holding a "general power of attorney" or "special power of attorney" and the legal counsel holding a "power of attorney";

  • the statutory auditors or auditors;

  • partners with unlimited liability who may know the company's data for the period during which they were partners and the period prior to their joining the company.

How to request access to data

The request form can be downloaded from this page and the interested party must:

  • fill out the form and sign it;

  • attach to the form a legible photocopy of their valid identity document.

The request can be sent from one's digital domicile (tNotice) to the address domicilio.digitale@bcsm.sm, or, in the case of persons residing, staying or having their headquarters in the territory of the Republic of Italy, consistent with art.5, letter b), of Delegated Decree no. 51/2023, by P.E.C. to the address segreteria.bcsm@legalmail.it , or, delivered in person or through a delegate, by appointment, or by registered mail to "Central Bank of the Republic of San Marino, Via del Voltone 120, 47890 San Marino".

The Central Bank sends the data by registered mail, registered electronic tNotice to the digital domicile, via P.E.C. with regard only to persons residing, staying or having their headquarters in the territory of the Republic of Italy, or the same may be picked up at the counter, by appointment, by the applicant or a delegate.

In cases where the aforesaid forms are delivered at the counter by a person other than the requesting party or in case of sending by registered mail, the authentication of signature by a notary registered in the Professional Register of Lawyers and Notaries of the Republic of San Marino is required; if the authentication of signature is performed by a notary not registered in the register of San Marino, the authentication must be legalized or provided with "Apostille" (for the States that have acceded to the Hague Convention of October 5, 1961).

If documents issued by other foreign authorities are attached, it should be noted that legalized certificates or attestations issued by the competent authority of the foreign state, in the Italian language, or accompanied by a translation in the Italian language in turn sworn before a competent foreign authority and legalized in turn, are considered valid.
Certificates are valid for six months from the date of issue.

Useful information

The personal data in the Central Risks Database are confidential in nature. Participating intermediaries observe the obligation of confidentiality towards any person outside the risk administration.

The reporting of data related to the Central Risk Office responds to a task of public interest and is carried out in compliance with Article 50 of the LISF in the exercise of supervisory activity, under exemption from the application of Law No. 171/2018 pursuant to Article 1 of Decree - Law No. 210/2020.

Reporting intermediaries are responsible for the accuracy of the reports sent to the Central Risk Service.
Intermediaries are required to check the risk reports sent to the CBSM and to rectify on their own initiative any incorrect or incomplete reports referring to the current and past detection.

Any disputes or requests for correction of data collected in the Central Risk Service should therefore be addressed to the said intermediaries, who are required to delete and correct erroneous reports as soon as possible.

Access to CR data under Article 42 of Law No. 94/2022

The Central Bank, pursuant to Article 42 of Law No.94/2022, upon request of the members of the Great and General Council (CGG) and members of the State Congress (CS), through the UO Institutional Secretariat Office, annually provides a prospectus containing cash loans classified as non-performing as of December 31 attributable to them, reported by the intermediaries participating in the Central Risk Service using the appropriate form available at the following link. Non-performing exposures are defined as non-performing risk positions reported in the individual's own name, in the name of joint ventures to which the individual belongs and in the name of partnerships of which the individual is a partner. The aforementioned prospectus is provided upon request of a spouse, de facto cohabitee outside marriage, to the person bound by civil union pursuant to Law No. 147/2018 and any dependents of members of the State Congress, using the appropriate form available at the following link.
In the case of a request from a member of the CGG or a member of the SC, said request must be transmitted through the UO Institutional Secretariat Office to the Central Bank by tNotice at domicilio.digitale@bcsm.sm.
Acknowledgements will be transmitted by tNotice to the UO Institutional Secretariat Office. In other cases, the procedures for sending the request and receiving the response are the same as in the section "How to request access to data."
