Article 9 of Law No. 154 of August 27, 2021, in supplementing the text of Article 17 a Law No. 55 of June 17, 1994 ( Provisions on Civil and Criminal Procedure) introduced the right for a creditor, upon due authorization of the Commissioner of the Law, to request from the Department of Tax Collector of Central Bank of the Republic of San Marino a view of the economic and financial situation of his debtor and the following information:
(a) the existence of pensions;
(b) the real estate owned;
(c) registered movable property owned;
(d) registered company shares, ownership of sole proprietorships, administrative positions held in San Marino companies;
(e) existence of employment relationships.
MODE OF DELIVERY AND WITHDRAWAL OF THE REQUEST
The request for visura, made by means of the appropriate form indicated below, may be delivered in person at the offices of the Tax Collector's Department or may be sent by registered electronic T-Notice or Certified Electronic Mail (PEC) andmust be accompanied by the decree of the Commissioner of the Law from which the name and surname of the debtor, ISS code and/or COE referring to the same are evident.
The Tax Collector's Department will deliver the visas to the creditor, through the same mode in which the request was made.
COSTS AND TIMING OF ISSUANCE
In accordance with the Law, the service will take place upon payment of the costs of € 20.00 for each individual view requested, with the exception of that relating to the ownership of designs, trademarks and patents for which € 50.00 requested by the issuing office for each individual title found must be added to the above cost, even in the case of a negative result.
The timing of issuance depends on how and when the data are processed and/or extracted from the relevant archives pertaining to the offices of the Public Administration.
